Let's take Trump's "sue the EU" seriously (yes, I know). UK could have challenged EU negotiating guidelines or mandate. CJEU could have fast tracked the case with a judgment in four months. CJEU might have struck down the mandate in whole or part but many issues left unresolved.
Or the UK might have lost the case entirely. Risk of limiting EU negotiating flexibility further legally (depending on the judgment). Awkwardness of suing while presumably simultaneously negotiating. Absurdity of going to CJEU while demanding to end its jurisdiction.
