Kavanaugh will vote to overturn any new data protection/privacy regulation when it’s inevitably challenged by industry lobbyists. He’ll argue/agree that commercial surveillance is protected “speech”, essentially a Citizens United for the tech giants.
Tech companies can say whatever they want on Thursday to Congress. But if Kavanaugh is confirmed on Friday then they‘ll know their lobby can get just about any enacted privacy regulation overturned eventually.
Data Protection issues at stake include:
—Federal vs State authority
—Geolocation privacy
—IoT security/privacy
—Children
—China
—Facial Recognition
…and so much more.
Trump admin’s proposal:
1. Transparency urged
2. Control of supplied data (not inferred)
3. Minimized to industry preference
4. Security encouraged
5. Right of access (but not deletion)
6. Avoid scandals
7. Profoundly vague accountability

Don’t call it GDPR-lite. GDPR is based upon the EU charter which enshrines data protection as a fundamental human right. There are criminal penalties for violating it. It’s so comprehsive it governs genetic privacy and language requirements for explaining data policy to children.
