This thinking is flawed and dangerous. The BBC is repeating the mistake it made with Vote Leave's law breaking. It is creating a false equivalence between (a) an independent statutory regulator and (b) an individual the regulator thinks is a crook.
It is dangerous because the effect of the false equivalence the BBC creates is to undermine public trust in the independent organs of state: the regulators, the police, the rule of law. The BBC's actions invite people to question everything they do.
The BBC is a public service broadcaster and its actions are directly akin to that of Donald Trump using the authority of the office of the President of the United States to bring the superstructure of the State crashing down around him.

Then what?
How robust @AndrewMarr9's questioning is - and he is a good interviewer - is completely beside the point. The interview is an invitation to viewers to choose between what the independent regulator has said and what Arron Banks says. That is a false and dangerous equivalence.
