Another way of reaching the same conclusion is to say it’s not collusion for the president to simply desire to adopt Russian (or Israeli, or anyone’s) policy as our own. It’s the president’s prerogative to adopt his preferred policy wholesale from anyone he wants.
That’s just another of the weaknesses of the system. We thought oaths of office and other generalized pressures alone would preclude such an idea because they always had, so far. Making it illegal in itself either never occurred to us.
Surely the “illegal” kind would be marked by some identifiable quid pro quo that someone would be able to prove, and that would be the crime. Unless it didn’t get proven. Then it would just be disturbing background noise surrounding an otherwise inexplicable policy choice.
On the other hand, it could just be treason. But that presents its own difficulties in prosecution. We’ll just have to scratch our heads and wonder why that president wanted to cede policy control to others so badly.
Unless, of course, we decided to use the mechanism we give ourselves to declare him no longer president.
