EXCL: MoD accused of developing a secret policy on torture that allows ministers to sign off intelligence-sharing that could lead to the abuse of detainees.

MoD policy doc states that while there’s a presumption that intel won’t be shared when there’s a serious risk of torture, this can be overridden if “ministers agree that the potential benefits justify accepting the risk and the legal consequences that may follow”.
The policy, dated Nov 2018, was obtained by FOI by @renditionprjct

The Investigatory Powers Commissioner’s Office, which oversees gvt rules on intel sharing relating to detainees, hadn’t seen MoD policy until @Reprieve passed it the FOI last month.
Ipco has now raised policy with the MoD, which accepts it “will need to be amended” once new Cabinet Office guidance on the issue is finalised. No detail yet on what amendments it will make.

It’s understood that Ipco will examine the policy during its next inspection.
David Davis, former cabinet minister & civil liberties champion, calls on Penny Mordaunt to rescind “dubious” policy.

Writing for Times, he says: “Torture never works and is always wrong. Our armed forces know it and our laws confirm it.”
