1/ AG Barr has an op-ed in the WSJ today about nationwide injunctions with some *extremely* revisionist history, to put it kindly, about Trump and #DACA. Let's take a stroll down memory lane. wsj.com/articles/end-n…
2/ Barr claims that the nationwide injunction entered by a federal court in CA on January 9, 2018 "proved catastrophic" to efforts to find "a political compromise" on #DACA. The injunction (and similar orders from courts in DC and NY) required DHS to continue processing renewals.
3/ First of all, this a crisis entirely of Trump's own making. Then-AG Sessions and the Texas AG cooked up the mere threat of litigation over #DACA, which has never been found unlawful or unconstitutional, as a pretext for ending the program on 9/5/17.
4/ The point then and the point now, as Trump's own tweet this AM reaffirmed, was to end #DACA, take the Dreamers hostage, and use them as bargaining chips to get money for The Wall and massive cuts to legal immigration.
5/ Now let's talk about all of the deals that Trump rejected. First, there was the infamous Chinese food summit with Pelosi and Schumer in mid-September 2017. They made a deal on #DACA and border security and then Trump reneged. This will become a pattern. nytimes.com/2017/09/13/us/…
6/ And then came the Cheeseburger Summit in January 2018, where Schumer offered *$25 BILLION* for The Wall in exchange for permanent protections for Dreamers. You'll note this major offer came AFTER the supposedly "catastrophic" nationwide injunction. msnbc.com/rachel-maddow-…
7/ This was also right around the time Trump made his infamous comments about "shithole countries," and he and hardliners like Stephen Miller ramped up their demands for massive cuts to legal immigration in return for protecting Dreamers. washingtonpost.com/politics/trump…
8/ Following the brief govt shutdown, Senators again tried to craft a compromise. And Trump and Miller again ramped up their demands for huge cuts to legal immigration, wanting to slash it in half. Not coincidentally, it would've also kept a lot more Africans et al out of the US.
9/ In February 2018, Senators were on the verge of a big compromise that included protections for Dreamers, $25 and BILLION for border security. But then in the middle of the night before the vote, DHS issued an insane memo claiming the compromise could lead to another 9/11.
10/ After the insane DHS memo and last-minute pressure from Trump, Miller and other hardliners, the bipartisan compromise failed 54-45. The extreme Trump-Miller proposal got a mere 39 votes. vox.com/policy-and-pol…
11/ And so it has gone. Every time a deal has been offered to Trump, including full funding for The Wall in exchange for protecting the Dreamers, he has reneged, walked away, or blown it up.
12/ Meanwhile, Trump's manufactured crisis has thrown the lives of nearly 800,000 #DACA recipients into limbo for two years. So if AG Barr wants to know what has "proved catastrophic" to any deal on immigration, he should look beyond the courts and focus his attention on Trump.
