Here is the number-two House Republican not only ignoring the real story, but literally _making up_ a lie to try to shift focus away from @realDonaldTrump's misconduct. The complaint was _dated_ August 12; that's _not_ when @RepAdamSchiff "knew about it."

So. Much. Bad. Faith.
@realDonaldTrump @RepAdamSchiff By law, the complaint had to go to the IC Inspector General first, and then the (Acting) DNI, even though it's formally _addressed_ to the chairmen of the two congressional intelligence committees:

One of the cases #SCOTUS could add to its docket as early as today is DHS v. Thuraissigiam, which raises whether the Constitution’s Suspension Clause (which protects a detainee’s right to judicial review) applies to undocumented immigrants _in_ the U.S.:

This is, potentially, a hugely important case for the constitutional rights of undocumented immigrants—and one of the issues on which there may be real daylight between Justice Kennedy (who in 2008 was the fifth vote to apply the Clause to #GTMO detainees) and Justice Kavanaugh.
And a cert grant is likely; there’s a clear circuit split between the Third Circuit (which held that the Suspension Clause does _not_ apply to undocumented immigrants subject to expedited removal in 2016), and the Ninth Circuit, which reached the opposite conclusion in this case.

The Trump Administration has certainly _stretched_ the language of the Federal Vacancies Reform Act, but unless I'm missing something, I don't see a remotely plausible argument that Cuccinelli could be named Acting DHS Secretary under 5 U.S.C. § 3345(a):

Cuccinelli is _not_ the first assistant to the Secretary under 3345(a)(1).

He hasn't been confirmed by the Senate, so that nixes 3345(a)(2).

And he wasn't a senior DHS employee for 90 of the 365 days before the Secretary position became vacant on April 10, 2019, per 3345(a)(3).
The Administration could try to argue that "the applicable officer" under 3345(a)(3)(A) is McAleenan, not Nielsen, and Cuccinelli has been at DHS for 90 days while McAleenan has been Acting Secretary...

But that's belied by the text of the first sentence of the statute:

The Office of Legal Counsel’s formal explanation for why (Acting) DNI Maguire didn’t (and doesn’t) have a statutory obligation to forward the whistleblower complaint to the congressional intelligence committees is remarkably thin.

A mini-#thread on why:
In a nutshell, OLC’s argument is that, on the merits, the underlying complaint doesn’t satisfy the substantive criteria for an “urgent concern” under the statute.

The problem is that the statute expressly leaves that call to the Inspector General, and not the (Acting) DNI:
Once the IG finds that the report is credible (whether he is right or wrong), the statute imposes a mandatory obligation on the (Acting) DNI to transmit the report and the IG’s findings to the congressional intelligence committees. This language is not remotely ambiguous:
