@TrineeshB More from that paper on the 1923 general election (the last one in December). Interesting views on protectionism and employment. Labour and the Liberals agreed on this but little else. And John Maynard Keynes had something to say.

How important are appeals for WTO legal disputes?

Pretty important, but not (yet) life-and-death for the organisation.

In one month on Dec 10 the Appellate Body, which hears appeals in the disputes, will have only one member left, which is not enough to take up new cases

It remains to be seen whether the two whose terms are expiring on December 10 will stay on, at least to finish appeals they are currently considering.

Whatever happens, eventually appeals will not be possible. Some countries are considering work-around solutions (see 6/6)

But the WTO is not just about disputes, and international trade under the WTO does not rely on disputes to continue to function.

Here is some data to demonstrate why. They are figures for non-tariff measures (“SPS” and “TBT”) introduced by WTO members since 1995.

Having a low or zero tariff within a quota (and a high tariff outside) does not ensure that the quota offers real market access.

How the quota is managed — how importers and exporters access the quotas — could obstruct trade.

China can retaliate against the US for failing to implement a ruling in an anti-dumping dispute, to the value of up to $3.6bn pa, WTO arbitrators say — probably the 2nd largest ever after the recent $7.5bn pa awarded to the US over Airbus subsidies.

Retaliation by the complaining country (China) is allowed if the other country (US) fails to implement the ruling correctly.

It usually takes the form of high or prohibitive tariffs.

China had proposed retaliation of $7bn. The US said this was too high.

The arbitrators agreed. The $3.6bn awarded is designed to ensure the loss of trade (US exports to China) does not exceed the calculated damage caused to Chinese exports to the US as a result of the illegal methods the US used to calculate anti-dumping duties.
