Justice fails deadlines and is forced to release prisoners
Courts do not make judgments and witnesses invoke a state of emergency in order not to appear.
The fact that there is almost no trial or process instructions due to Covid-19 means that within
a few weeks many of the preventive prisoners, for the most varied crimes, have to be released.

The counties from North to South of the country have not carried out trials - nor those considered urgent - due to the lack of public health conditions. Many of the listed witnesses
also refuse to appear in court - citing the same health reasons - which increasingly raises problems in terms of deadlines.

The most publicized case happened a few days ago, with Carlos Alexandre, a judge at the Central Court, releasing seven preventive prisoners in the Tancos
case. Unable to finish the investigation by April 21 - the date on which the prison terms expired - the magistrate ordered the immediate release of the defendants who were subject to the most severe coercive measure.

The magistrate still tried to conduct the instructive debate
, but many lawyers assured that they would only do so in writing. Because the law requires the due diligence to be in person, the judge cleared the due diligence and released the suspects.

The situation can be repeated in hundreds of other processes, whose deadlines are close
to ending. There are also security problems in the transportation of prisoners to the courts, due to the lack of protective material in the jails.

With the law stating that the evidence is only made at trial, the cases at first instance are at risk.

The determination of the
Superior Council of the Judiciary was that urgent cases should be carried out in order to avoid the extinction of coercion measures, but the situation has worsened in the meantime and the determination of the state of emergency has allowed many of the procedural actors to refuse
to appear in court. .

The situation regarding appeals to higher courts does not arise, as urgent cases continue to be dispatched and the appellants do not appear in court.

Tight deadlines
Homicide cases have tight deadlines. The prosecution has, for
example, to be released in just six months and the investigation in another four months.
