U.S. District Court Judge Timothy Kelly is ordering the Trump administration to immediately return the White House press credentials of CNN reporter Jim Acosta. He is a Trump appointee.
CNN had asked that Acosta's credentials be returned while a lawsuit over their revocation goes forward.
The pass has been returned temporarily until the case has been argued and a judgment is rendered.
This is annoying but expected. Much will be made of the fact that Judge Timothy Kelly is a Trump appointee, having joined the bench in D.C. just 14 months ago, but the decades-old Sherrill ruling from the D.C. Circuit didn’t leave him much room to maneuver.
That’s the leading precedent, and a district court judge is duty-bound to follow it.
