A team of DEA agents raided a house hours before they applied for a search warrant.

7th Cir.: "We do not condone this illegal behavior by law enforcement," but the agents did get a warrant after the search, so no need to suppress the evidence they found inside the house.

For those who’ve asked, the panel - which was unanimous - was two judges nominated by Trump and one nominated by Clinton.

This is a pretty aggressive argument from DOJ, basically saying that Congress is lying about its purpose for wanting the president's tax returns and that as a result, the IRS need not provide them even though the statute doesn't require Congress to have *any* reason.

DOJ's view of the law tracks pretty closely with what President Trump's private lawyers have argued in court: That Congress can't gather information unless it has a "legitimate legislative purpose," and just investigating wrongdoing doesn't count.

I've been trying, but I'm still perplexed by the president's argument that trying to figure out whether someone broke the law is a law-enforcement function reserved to the executive. Prosecuting, sure. But obtaining information doesn't seem like enforcement to me.
But on the other hand if gathering information to figure out whether someone has broken the law counts as law-enforcement, I am pleased to discover that I and many other reporters have had a career in law-enforcement.
(I once even used a radar gun to investigate whether people were breaking the law, as @PGDougSchneider can attest. That investigation pretty readily showed people were breaking the law, but I wouldn't say I was enforcing it.)

President Trump's lawyers have filed their D.C. Cir. brief challenging a House subpoena for his financial records. They're doubling down on the argument that Congress "is attempting to exercise law-enforcement powers."
Trump's lawyers argue that if Congress has an interest in examining the president's financial records, it could also scrutinize those of Supreme Court justices.
Trump's lawyers argue in a new D.C. Cir. brief that Congress does not have the power to investigate whether the president broke the law. They say only the executive branch - the people who work for the president - is allowed to determine whether the president broke the law.

At the outset of the #Brexit process, most people assumed that a deal on #police and #judicial co-operation was easier to get than one on #trade. Time has shown this is not the case. Ongoing co-op on #JHA is one of the few items yet to be agreed on #withdrawal deal. Why?
Well, because the #EU and #UK's opening positions in the #negotiation are incompatible: Britain wants a #bespoke agreement with the EU, a la #Schengen, but is not willing to accept #ECJ or #EUCharter. EU wants to replicate existing models. What to do?

No legal representation = no attorney-client privilege.

Feds argued there is no attorney-client privilege for Cohen because Trump fielded a couple of question about Stormy Daniels civil case last week (5April18).
