NEW COHEN THREAD —>
Michael Cohen Is In Court Over Materials The FBI Seized In A Criminal Investigation buzzfeed.com/amberjamieson/… w/ @ambiej
This will be the thread where I cover the news out of today's hearing on how to handle the materials seized in last week's searches. @ambiej is in the courtroom.
Here we go. Follow @eorden and @KlasfeldReports for tweets from the hearing —>
(SDNY is no joke.)
Some insight into the timeline that SDNY is looking into in the Cohen criminal investigation —>
This is a key question, have Trump/Cohen's efforts to try this publicly led them to go far afield of the types of arguments that might be more persuasive to a judge?
A "publicly prominent individual," Cohen's lawyer says.
This drama! [As discussed in an earlier thread, I have almost no doubt that the name should be revealed.]
This is the case cited by Cohen's own lawyers for withholding the name — and the lawyer lost: openjurist.org/992/f2d/449/vi…
Here's the lawyer speaking up for press — hence, public — access:
BOOM.
HOLY HELL.
Hannity acknowledges it:
This is from early in the campaign:
Oof.
This is a situation where unnamed sources are not all that helpful, imho, due to the varying motives of different parties right now:
"We definitely had attorney-client privilege because I asked him for that ... I never used Michael [Cohen] in any case that involved me and a third party." - Sean Hannity
Yes.
So, as @nycsouthpaw said earlier, either this is not accurately portraying the relationship, or there are basically no A-C privileged files at issue — which would undermine the argument Cohen's lawyers are trying to make in court.
Back to the matter in court, Trump's lawyer makes it clear that she believes the case should be treated differently because the president's personal lawyer and materials relating to the president are involved:
Back to Cohen and Hannity. Hannity's latest tweets and the letter from Cohen's lawyers this morning appear to contradict. Can you explain, @seanhannity?
Back to court, where Wood has not yet decided on whether she'll appoint a special master, after calling the SDNY US Atty's Office taint team procedure a "viable option."
Here is @ambiej’s must-read thread on what happened in court today —>
