Per this @nakashimae/@missy_ryan story on the American #ISIS fighters being transferred stateside to be tried in civilian court, it’s not just that sending them to the #GTMO military commissions would be stupid; there’s also no legal authority to do so.

Under the Military Commissions Act, only an “alien unprivileged enemy belligerent” can be tried by the #GTMO tribunals:

US citizens can still theoretically be tried by military commission under World War II-era precedents, but (1) only for international war crimes; and (2) under different authority than the #GTMO commissions:

With no noted dissents, #SCOTUS summarily denies stay sought by the unnamed, foreign government-owned corporation arising from a contempt citation for defying a grand-jury subpoena related to the Mueller investigation:

This is not a surprising result.
As a result, the accumulation of the contempt fine will resume—which should presumably put (increasing) pressure on the mystery foreign government-owned corporation to either comply with the subpoena or to otherwise cooperate with the Soecial Counsel in exchange for dropping it.
This doesn’t end the appeal; the mystery corporation can still ask #SCOTUS to take the case on the merits. But the denial of the stay (and the absence of any noted dissents) is a pretty strong signal that the Justices are inclined to sit this one out.

A reminder that we could hear from #SCOTUS as early as today with respect to whether it will continue or vacate Chief Justice Roberts’s administrative stay of the contempt citation against the unnamed foreign company that apparently defying a Mueller-related grand jury subpoena.

Tonight, the 1st of my 2-part series on #ISIS’s resurgence in Iraq airs on @PBS @NewsHour Weekend. In cooperation w/ @theIFUND, I spent 3 weeks traveling across 3 provinces to investigate the extent to which ISIS has regrouped after its official defeat last year.
In August, Abu Bakr Al Baghdadi released a new audio recording in which he pointed to #Iraq as the epicenter of #ISIS's resurgence. The facts on the ground suggest that this is not just an ambition the group aspires to in the future - it’s already a reality.
ISIS attacks in the rural areas around Tuz Khurmatu, Kirkuk and Hawija aren’t an exception - they’ve become an almost daily occurrence for the civilians who live there. What’s more - #Iraq’s security forces appear ill-equipped to face #ISIS in its insurgent form.

For 1st time since 2014, UN peacekeepers are back on Golan heights - #Syria frontier. As the situation stabilizes further, these posts will be handed over to Syrian government forces. Overnight, Israel was on high alert as #ISIS fighters tried to cross into its territories ==>
2-This is a significant realization by #Israel & others that the earlier foolish policy of arming and supporting militants on its border had to be reversed. It is now clear that without the Syrian State, the void will be filled by uncontrollable cocktail mix of armed groups
3- Significant myth that was promoted by observers was that presence of Syrian State is likely to bring more chaos & instability than other way around. To help this argument, such groups promoted Shia/Sunni discord & argued only way to calm majority Sunni fears was to defeat SAA

Really fucked up situation in NW Syria right now, which I'm trying to get my head around. The following is how I understand it - let me know if you think I've got it wrong:
1.a ISIS has played a really smart series of moves in Idlib/Hama. First, in the Autumn, they did a deal with Russia/regime to transfer fighters from Deir Ezzor into Idlib, where they quietly switched to counter-insurgency mode...
1b. The Syrian government & its Russian media allies promoted a false "ISIS defeated in Syria" narrative, while 1000 ISIS fighters regrouped in Idlib/Hama...
