I am not sure DOJ misled. At least one DOJ lawyer at yesterday’s hearing sounded shocked the President had demanded rethinking census question in a tweet. But NOW DOJ credibility will be on the line, and I have no faith in AG Barr to do the right thing.
The entire Trump issuing executive order to put citizenship question on census (per @axios) is bizarre. #SCOTUS did not question executive branch power to do this. But it has to give a nonpretextual reason complying with administrative law. That should come from Wilbur Ross.
That said, I wrote @Slate on day of #SCOTUS decision that I thought CJ Roberts left the door open for census question do-over and the issue could be back before Court in summer. slate.com/news-and-polit…

My bottom line is that—executive order or not—if Trump tries again with citizenship question on census, Chief Justice Roberts is the only one that matters and he will be put off by this amateur hour.
