US 2019 NDAA appropriated funds for @StateDept to deal with #Syrian war crimes & genocide. @SecPompeo has done nothing on it. IMO Assad regime can authorize the SDF to try them in military tribunals with SAA & impose sentence.
2. A civil tribunal should be stood up by the SDC with Damascus' authority. Civilian tribunal gives higher level of due process. The issue of criminal guilt is all that need be proven. ISIS committed pretty much every crime, including all war crimes and genocide such that it's

Syrians need to be judged by their own folks. Arabs have no interest in allowing ISIS back. Syrian motivation to join ISIS was entirely different from the foreigners.'

In NE Syria, all foreign
4. fighters were there for economic reasons. They engaged in a massive robbery murder rape & genocide based criminal enterprise goals and IMO they should not be considered lawful combatants and IMO are not considered lawful combatants under international law.
5. The Syrian nationals in ISIS included a number of local Sunnis forced to join but mostly committed members of Daesh who I learned from folks on the ground were, to a person, ideologically motivated. True jihadists. Not like the economically motivated foreigners.
6. It's been my view the Syrian nationals need to be treated differently at the adjudication stage. They are not foreign unlawful combatants, they are Syrians in Syria who are owed a fair trial by law and subject to Syrian legal penalty and mercy.
7. All this can begin to form the federal system that's necessary for Syria to survive. Creating local dispute resolution mechanisms based on internationally recognized human rights and national and local custom. Any capital sentence should await the freely and fairly elected
8. govt under the Geneva process. We can still see a stable secular democracy in Syria. The creation of a competent judicial system free of corruption is the key. That's what we need to be working on and we have a statute to ride on. Fund the war crimes tribunals.
