Let me lay out what this means for those interested.
The implication is that the Democratic states and House Dems are asking the USSC to hear the case without having it head back to the same judge who originally ruled against it.
The uncertainty needs to end.

It only takes 4 Justices to decide to take the case. If the 4 liberal Justices decide to take the case, then the case could be heard either by the end of this term (June 20) or beginning of the next term.
If the 4 liberal judges do this it would be because they (likely correctly) think the Roberts court with this make up is the proper court to hear this.
The more time, the more uncertainty, and the more things could change. This needs to end.

One member of Congress asked me if it was possible the conservative Justices would vote to hear the case and the liberals wouldn’t.
I obviously don’t know how any of them will vote but this scenario seems unlikely. Becerra seems to agree.
