The most likely option, I am told is for EU to decide the Benn act’s three months extension is “technical” as long as early WAB votes go smoothly
That could be done by written procedure and would be “fungible” meaning it could be shortened to end on the 1st or 15th of Nov, Dec, or Jan 2020 if the deal is ratified
If a longer political extension is needed beyond Feb 2020 because ratification breaks down or Johnson loses vote of no confidence than EU will need a summit - as early as 27/28 October

No extension decision tonight 
This evening's Coreper is "information point" or state of play pooling views in all 27 capitals
On Friday if there is a consensus decision will be by written procedure for Benn act Jan 31 2020 - or a shorter extension, perhaps a month until Nov 30
EU wants to hear what Johnson wants, many see Benn act date as most neutral but could be a shorter one
If there is no unanimous agreement for written procedure by Fri then #EUCO next Monday, 28 October
Clarification: the decision to seek written procedure or to go for a summit is up to Tusk. His call on Fri - not Coreper

European ambassadors meet tonight for discussion on Tusk’s recommendations - what Johnson has told him will be critical
It’s fair to say he’s jumped the gun, forced the issue, chances for disagreement have risen and thus another #EUCO
So written procedure is still the plan but odds are shortening on a summit
So we might well not get sign off today - French expected to moan but not (YET) to drag everyone to Brussels. Macron's Jupiterian is just rumour

European ambassadors met for all on the15 minutes this morning and did not discuss a new Brexit delay
It is full on ratification on the EU side mirroring the government’s push to get the deal across the line
Tusk has said his consultations will take a “few days” what that means that the EU will wait and see how the Commons vote on Tues before any decisions on extension

Last week me & others objected to parts of the British press pushing the idea that Juncker was "ruling out" an extension. Reasons: 1/ by law he can't & 2/ this spin was on by No10, in a bid to push the deal through parlt. Now that's failed, let's see what this extension is about
Jan. 31 2020 is the date laid out in the Benn Act. The EU does not want to come up with its own new deadline. Shorter than 3 months wd be seen as helping Boris. Longer, as trying to help Remainers by backing a 2nd referendum. So they are likely to take the date the parlt passed

It's going to be an awful day. Several hours of debate. Then a vote on second reading. Then, assuming that passes, a vote on the programme motion. Then three hours of committee.
The second reading vote does not seem that important. Many MPs who will vote for amendments, and who might even ultimately vote against the bill, will vote for it at second reading in order to get it onto the amendment stage.

Under the Benn Act there was an inescapable duty for an extension request to be sent

No way round it

Had the request not been sent, the Benn Act would have been breached

The averments (ie, promises) to the Scottish court would have been breached

The Lord Chancellor, Scottish Advocate General, Attorney General all would (or should) resign
