I’m pretty certain that a pharmacist refusing to dispense the morning after pill on religious grounds would breach the Equality Act and/or the Human Rights Act rightsinfo.org/is-it-legal-fo…
There may be a little wriggle room, e.g. asking someone else in the pharmacy to do it because you don’t want to, or referring to another pharmacy (this seems dubious) but refusing outright would potentially breach article 8 ECHR (as NHS service) or be indirect discrimination
There is a right to religious freedom reflected in the guidance but it rightly requires a patient centred approach where a pharmacist’s beliefs are not imposed on a patient. The case law is clearly in favour of providing services without discrimination regardless of your beliefs
There was a human rights case in 2001 when religious believers lost on exactly this basis - refusing to dispense contraceptive pill, though in that case they were objecting to being convinced of an offence in France for refusing to do so hudoc.echr.coe.int/app/conversion…
Thinking it through, I'm not sure that in the context of the morning after pill it would be appropriate to refer to another pharmacy, unless very close by - in light of the urgency and sensitivity for patients. Happy to hear views. This is the guidance pharmacyregulation.org/sites/default/…
