@nycsouthpaw Smarter lawyers than me are arguing with Goldsmith's constitutional analysis, but the correct rebuttal is "The Constitution does not permit the president to act as a Manchurian candidate and then permanently conceal that fact from everyone, because HELLO, OF COURSE IT DOESN'T"
@nycsouthpaw "You see, Trump has discovered the loophole that lets him commit crimes and betray America with no possibility of being legally caught. You do hate to see it"

Yeah, no. The Constitution is intended to create functioning government, not act as solvable puzzle for malefactors
@nycsouthpaw There are, in fact, some notoriously permissive presidential powers, powers that could be used to shield the president - the pardon power comes to mind.

What distinguishes these is that THEIR PERMISSIVENESS WAS KNOWN IN ADVANCE, not discovered in the course of abuse.
@nycsouthpaw The current situation is Trump is committing previously unimaginable abuses, and then a bunch of scholars turning around and announcing, wow folks, he's got us outwitted: we have no choice but to grant his ability to commit those abuses. Like.. yes we do? Just say he can't do it!
