Splošni pristop glede zakonodajnega predloga Akta o digitalnih storitvah (#DSA), ki so ga minuli teden sprejeli ministri za gospodarstvo na zasedanju Sveta za konkurenčnost (@EUCouncil | #COMPET), odraža neambicioznost članic EU pri zaščiti pravic evropskih državljanov na spletu.
Oba zakonodajna dokumenta, poleg #DSA še Akt o digitalnih trgih (#DMA), sta pomembna za enotni digitalni trg. Čeprav splošni pristop, ki ga je sprejel @EUCouncil, predstavlja določen napredek, pa še zdaleč ne zagotavlja ustrezne ravni varstva evropskih državljanov in potrošnikov.
Pripravo splošnega pristopa zaključuje tudi Odbor Evropskega parlamenta za notranji trg in varstvo potrošnikov (@EP_SingleMarket | #IMCO). S tem bo tlakovana pot, da Svet EU (@EUCouncil) in Evropski parlament (@Europarl_EN) prihodnje leto pripravita končno besedilo #DSA.

"access" does not means a "right to publish". Data, used, stored, accessed or published are governed by General Data Protection Regulation. #GDPR is highly protective of users, but, platforms like to use GDPR to shut down researchers accessing their data (like @algorithmwatch)

1st, politically:

Court approval for @EU_Competition mantra of 'self-preferencing' is huge; this concept underpins the last decade of action & rhetoric from Brussels, and now the whole world.

Court blessing for that will be read as: 'keep going, you're on the right track.' /2
Losing this case would have been a horror for the entire policy drive, for cases against @Apple @amazon @Meta & for @vestager reputation. As it is, EC goes into all that strengthened.

Court also said Google's "abnormal" conduct can't be explained away as the right to innovate/3

#DMA getting more complex by the minute. Today, national #antitrust watchdogs weighed in with a joint paper, saying they want to enforce it as well.

First half of the paper is a big brag about all the Big Tech work the authorities have done. Hard to contest this. Watchdogs in FR & DE have, in particular, been doing plenty in recent years. For them, this means they have loads of knowledge. And the DMA should make use of that/2
While @EU_Competition should be in the lead, the NCAs want powers to enforce as well. So, for example, this would mean @Kartellamt could suspect a tech abuse & deploy: EU Art 102, national dominance rules (two of them), GWB19a & then also the DMA. That's a lot. /3

Complainants go & complain about #self_preferencing to antitrust agencies re changes that disadvantage them. Fine. But online advertising is all dysfunctional & #GDPR has tools that must be used to address also

Nonono. There is *nothing* new in #DMA on digital mergers other than the obligation of #gatekeepers to inform. *Nothing* new on substantive assessment (unlike @CMAgovUK proposals). So *nothing* to prevent a new Facebook/Whatsapp or indeed #Google_Fitbit 1/
When asked about it at press conference, @vestager pivots quickly to importance of #interoperability. That’s key for rivals to compete but rest of us worry much more about #personal_data use in #health_tech. @EU_Competition why was so hard to see this deal is about #data 2/

I see a bit more interesting interaction between data protection rules and the #DigitalMarketsAct. Two points: (1) the obligation for gatekeepers to refrain from combining personal data from any other services offered by the gatekeeper or w PD from 3rd-party services, unless 1/
"unless the end user has been presented with the specific choice and provided consent in the sense of the GDPR" (Art. 5(a) of the proposal). And 2) the obligation for gatekeepers to submit to COM an annual independent audit w a description of the user profiling techniques 2/ #DMA
There are also data sharing obligations with third parties, including personal data, which are quite interesting. In fact, one of them speaks of "continuous and real time access" offered to business users (Art. 6(1)(i)) #DSA 3/

Some thoughts on the #DMA, while reading it.
"Weak contestability"??? Really? Leading to "less choice and innovation to the detriment of European consumers"? I am sorry, whut?!
Not so sure about that. The DSA is a truth-seeker (corresponding to the state of technical advances: impossible to prevent ALL illegal content > obligation to spot it after publication), while the DMA is a truth-teller (do's and don'ts). It's a much, much different philosophy.

Ahead of the release of the #DSA, let's take a look at what @vestager said previously.

- DSA will update the E-Commerce Directive (released in 2000)
- It will require digital services to take more responsibility for dealing with illegal content/dangerous goods
- They'll need to put procedures in place to deal with notifications about illegal content
- Need to make it more difficult for dodgy traders to use platforms
- eg by checking seller's ID prior to use of platform
- Platforms will need to provide simple ways for users to complain if they think their content shouldn't have been removed
- This will protect freedom of speech and rights of sellers using platforms
