In some ways, this is unsurprising. Since the #GDPR's beginning, it's been crystal clear that the intention of the landmark privacy regulation was to extinguish commercial surveillance and ring down the curtain on #ConsentTheater. 3/

Der #DigitalMarketsAct ist eine beispiellose Gesetzgebung für Verbraucherschutz & Einhaltung von (Straf-)Gesetzen. Hier das Beste aus 81 (!) Seiten. #DMA #Breton #Zensur (?)🧵 1/
Also los, was bringt der #DMA wirklich?
1. DMA trifft nur „Gatekeeper“, also z.B. 2/

2/ Scale, speed & supranat'l scale distinguishes big tech power now from when antitrust mvmt emerged in early 20C in response to Standard Oil. Scale allows these firms to threaten govts, as Facebook is doing now in Canada wrt to the Online News Act bill, ie deplatform news'. #C18
. @EuropeanCommiss #DMA prohibits Big Tech platforms to give advantages to their own services. So, too, does my fav part of #C18, the Online News Act (s51). This is way better than the weak beer found in #C11, the Online Streaming Act. #CRTC

Le Digital Services Act (#DSA) est publié aujourd’hui au Journal Officiel! 📖

I've been saying stuff like this for ages, maybe if @alexstamos says it too then people will listen? #DMA
Inevitably the response is something glib like "Use Matrix"
A big part of the the reason for the existence of that API was because the European Union wanted to enable people to access their data; so they created the problem, complained when the inevitable leaks happened, and are now reinventing it

Now that we have the text of the #DMA published, let me point out a couple of outstanding provisions that have data protection implications & that show why this Regulation concerns all businesses & platform users, not only gatekeepers. Let's go 🧵 1/?…
First of all, check out the list of Core Platform Services that may pull a business into the gatekeeper class (Art 2). Notably including web browsers, virtual assistants, & *online advertising services*, e.g. Exchanges, as long as they are provided by a business offering a CPS 2/
But this is not a thread about the threshold to become a gatekeeper (check Art 3). It just points out data protection implications of the #DMA. Of note, "consent", "profiling" in the #DMA are defined as in the #GDPR. Bonus: "non-personal" data & "data" are also defined 3/

Elsewhere in EU regulatory pipe-dreams authored by people who apparently have more good intention than understanding, the #DMA means that @WhatsApp and @signalapp should both adopt #XMPP and thereby deliver a unified "inbox" of messages.
@WhatsApp @signalapp Not making this up: ImageImage
> With a constant onslaught of messages pinging our phones and computers, who wouldn’t want that?

Well, for one, "people who use different applications to deliver different functionality and security profiles"

WhatsApp: family
Messenger: neighbours
Signal: infosec nerds

This week on my podcast, I read my @Medium column, "When Automation Becomes Enforcement," on the debate of interoperability and end-to-end encryption in the Digital Markets Act, and the long-running battle over who's in charge: you, or your computer?… 1/ Image
When I first encountered the idea of disappearing messages, I thought they were stupid, but I was wrong. I thought that the point of disappearing messages was to let you send secrets to someone you didn't trust, because the message would disappear and thus be safe. 2/
Obviously, this is stupid. If you send a secret to someone you don't trust, that untrustworthy person can take a screenshot, or use another device to photograph their screen. Or, you know, they can just *remember* the secret and blab it. 3/

Platform regulation #DMA: “ink is almost dry” on Art 5/6 various “thou shall not’s” for “gatekeepers”. BUT rules need translating into relevant prescriptions for each business model. We focused on e-commerce last week for a great discussion @cepr_org #Competition_RPN/ @MaCCI 🧵1/
Video recording can be found here 2/
Aside from public narrative (universally adverse), a ton of economic research underway looking at the behavior of hybrid marketplaces, esp. Amazon. What does it show? Does anyone care? Should regulators/enforcers care & acknowledge the tradeoffs? Or is it all beside the point? 3/

What's the big data privacy/security problem with EU techlash legislative proposals (#DSA, #DMA)?
🧵 A quick big picture explainer...
First, a general lesson on legal regulation. Law is not magic. Just because a law seems to require something (e.g. because it expressly says it does), it doesn't mean
(1) this thing will actually happen and
(2) the law actually requires it.
Just because a law says: "do this risky thing in a secure way", it doesn't mean that this law *really* allows doing that risky thing in a secure way. Wait, what?

#LSR Image

The #EU regulation for online Platforms, the #DigitalServicesAct (#DSA), plans in the article 31 to allow « access to platforms data for vetted researchers ». Unpopular opinion: it is a bad idea…
Some approved experts would be allowed under certain condition, access to some inside data from the platforms. What can go wrong ? Let’s ask the annoying quetion : what kind of access, what is "data" and how do we plan to organise the "vetting"
"access" does not means a "right to publish". Data, used, stored, accessed or published are governed by General Data Protection Regulation. #GDPR is highly protective of users, but, platforms like to use GDPR to shut down researchers accessing their data (like @algorithmwatch)

I've slept on it. Here's a 'tepid-take' (HT @DrMJCole) on Google ruling.
- politically: huge for @vestager
- practically: won't change much becoz #DMA is new kid in town,
- legally: EU judges' stance on 'essential facility' will cause controversy & perhaps an appeal
1st, politically:

Court approval for @EU_Competition mantra of 'self-preferencing' is huge; this concept underpins the last decade of action & rhetoric from Brussels, and now the whole world.

Court blessing for that will be read as: 'keep going, you're on the right track.' /2
Losing this case would have been a horror for the entire policy drive, for cases against @Apple @amazon @Meta & for @vestager reputation. As it is, EC goes into all that strengthened.

Court also said Google's "abnormal" conduct can't be explained away as the right to innovate/3

Power & control are particularly important 4 #socialmediaplatforms. "Clicks matter. The more content is seen and shared, the higher the income from advertising. Hence, it is not so much the quality or the truthfulness of the content that matters but its “virality”" 1/2

🚨In Brüssel tobt derzeit eine Lobbyschlacht. Mit Rekordausgaben für Lobbyarbeit wollen Google, Amazon, Facebook & Co strengere Regeln für Internetplattformen verhindern. 🧵(1/7)

Wishing all the best to Slovenia during its Presidency of the Council of the EU 🇸🇮❤️🇪🇺. There are huge challenges and legislative files ahead, and I sincerely hope Slovenia can make as much progress as possible. I welcome the efforts for some outlined priorities. BUT!... Thread👇

The Slovenian government has followed Poland and Hungary down to the authoritarian path with "war on media", unlawfully canceling the nominations of EPPO delegated prosecutors, therefore inadmissibly undermining the independence of the judiciary.…
