Yet, the FND is pled as Ripple’s Fourth Affirmative Defense. Is Ripple’s FND argument different or unique than previous one’s? Yes!

But we must first fully understand the nature of the FND and when, if ever, it would become relevant in the case.
To fully comprehend Ripple’s FND, we must first distinguish it from the typical “fair notice” argument that has been raised in previous crypto cases (e.g. Telegram, Kik, @LBRYcom).
We must also distinguish Ripple’s FND from arguments regarding issues of selective enforcement (the issue that some projects get a free pass while others get prosecuted) or the issue of regulatory capture by a select few investors who have captured transient regulators. 🤔

I defend secondary market sales of #XRP as well as other tokens sold in the secondary market (ie #LBC), not @Ripple or @LBRYcom.

When I sued the SEC, people immediately called me the #XRP Attorney even though I disclosed up front that I owned more in #BTC & #ETH than #XRP.
I was shocked that more people didn’t read the Complaint 🆚 Ripple the way I did - b/c it attacked the token itself and didn’t focus on the circumstances surrounding the way Ripple offered and sold #XRP.

Many allegations about #XRP applied to all other tokens.

For example:
“The nature of XRP itself made it the common thread among Ripple, its management, and all other XRP holders.”

The “nature of XRP itself”?

Wtf does that even mean?

The SEC is asserting that by simply owning a token you are in a common enterprise with ALL other token holders!

During this 🧵, I share the interview I did w/@Jay_SpendDBits well over a year ago when I was researching the #XRPLedger and independent developers who have no connection to @Ripple or its executives.

@Spend_The_Bits is a PERFECT example of what’s wrong w/the SEC lawsuit.
In fact, there have been 15 Amicus Briefs filed in the @Ripple case and if Judge Torres were to inform me that she was only going to read one Amicus Brief but was going to allow me to pick the one she reads, I would tell her to carefully read the @Spend_The_Bits Amicus Brief.
The @Spend_The_Bits Brief may be the best at demonstrating how flawed the SEC’s all-encompassing #XRP theory is.

Like most in Crypto, Jay read the #Bitcoin White Paper and bought #BTC
He knew #Bitcoin was going to be part of the future and decided to develop a payments app.

“The same reasoning applies to digital assets. The digital asset itself is simply code. But the way it is sold – as part of an investment; to non-users; by promoters to develop the enterprise – can be, and, in that context, most often is, a security.”

- Bill Hinman, 06/14/2018
Notice that the asset is more a security if it is “sold as part of an investment - to non-users - by promoters.”

Clearly, #LBC users w/in the @LBRYcom Blockchain who didn’t purchase the tokens from LBRY or its executives DO NOT FIT with what Hinman articulated.

[1/🧵] — #XRPL (#XRP) vs. @Ripple #CBDC

When was the last time you did an analysis of the distribution of #XRP on the #XRPLedger?

How and where can you even do that?
And can you do it yourself at all?

I'm happy to show and I've also worked up the data (visually) directly.
Next, for those who might not know, @xrpscan ( and @bithomp ( are excellent blockchain explorers (and more) for the #XRPL!
Hearty shout out to the teams of both services whose provided data I used.
And also to @WietseWind with whose help the easy creation of the pure data of the #XRPL was possible at all (for me) as well as to @Ripple and its operation of the "S1" server ( from which I extracted the data of the XRPLedger for this.

[1/🧵] I've been reading a lot about #XRPL #scalability recently.

Let me quickly go through how #XRPL performs and #scales on these metrics:

▶️ Scale up "vertically"
▶️ Scale out "horizontally"
▶️ High volume & High value TX
▶️ High value & Low speed Source:
[2/17] 👉 Asynchronous TX speed—Scale up "vertically"

In contrast to #DAG-based systems, which operate in "chaotic order" and execute transactions in parallel, the #XRPL validates transactions in canonical transaction order—one Ledger at a time.

[3/17] . . .

❓ The approach for #DLT/#Blockchain-based systems such as #XRPL:
☑️ "Payment Channels"

🧐 It's a sophisticated feature for transmitting "asynchronous" #XRP #payments that may be broken into extremely small amounts and paid in total order afterwards.

Something to discuss maybe …

Iam curious if anybody know a answer to my question...

The upcoming (EVM)Sidechain on the #XRPLedger uses Tendermint as a consensus mechanism and uses Proof of Stake (PoS)...
So the EVM-Sidechain needs PoS-Validators and Delegators... it).

but on the most PoS-Chains, unfortunately, there is always 3-5 TOP Validators which mostly together account for more than 50% of the Stake...

Is it possible to define an max limit(in %) that can be delegated to a validator? And would that be something from which…

the decentralization grad on the EVM-Sidechain could benefit? (And so the XRPL)

I mean, I could well imagine that if e.g. #Ripple provides a PoS validator, that's exactly where a large part of people will delegate their #XRP’s (eXRPs) to.

[1/🧵] That is a genuine question, and while the answer may disappoint you, it isn't as important as one may believe.

Let's go back in time to find out what happened and thoroughly address the question. 🧵👇
[2/19] 🧐 First and foremost, let us establish some fundamentals and address the question:
❓ Is "block" the proper term to use ❓

Yes & no, as @JoelKatz puts it:
"The transactions are stored in a series of ledgers, but an #XRPLedger contains everything a block contains.
. . .
[3/19] . . .

So because it’s a chain of ledgers, it’s also a chain of blocks."

The primary distinction between #Bitcoin and #XRPL is that the #XRPLedger utilizes an account model rather than a #UTXO model, thus the term "Ledger".…

When @EleanorTerrett and I were discussing the @SECGov summary judgment, I didn’t bring up the one thing that stood out the most, b/c I had only read it once, right after reading @Ripple’s brief. I didn’t want to misspeak or be wrong. I’ve now read the @SECGov’s brief a 2nd time.
What, without a doubt, is the most glaring thing missing from the SEC’s motion for summary judgment?

There is NO SEC expert testimony attempting to prove price correlation between the efforts of Ripple and the price of #XRP.
There is NO SEC expert testimony claiming #XRPHolders relied on the expertise, skill or management of the Ripple team OR expert testimony claiming #XRPHolders were led by promises and inducements made by Ripple, before acquiring #XRP.

When I filed the motion to intervene in @SECGov 🆚 @Ripple on behalf of #XRPHolders, I used @Spend_The_Bits as a great example of why the Judge 👩‍⚖️ must allow us to be heard in the case.

@Jay_SpendDBits WITHOUT any help or 💰 from Ripple developed a payment app utilizing #XRPL.
#SpendTheBits will also be referenced in our Amicus Brief. According to Jay Kambo, @bgarlinghouse @chrislarsensf and @JoelKatz were completely unaware of who he was or of his idea to develop a payment app that allows you to spend your #Bitcoin JUST AS Satoshi Nakamoto envisioned.
That’s the beauty of the underlying technology. The #XRPLedger is an open permission-less distributed ledger technology - emphasis on “open and permission-less.”

Jay Kambo didn’t ask for permission - he just started building.

The best example of the absolute absurdity of the @SECGov’s claim that #XRP is a security is highlighted in the video below 👇

#Bitcoin Maxis say ⚡️ is the only way to spend #BTC quickly. Not True! What blockchain technology was DESIGNED specifically for payments: The #XRPLedger
@Spend_The_Bits utilizes the #XRPL as a Layer 2 solution to solve how slow #BTC is. Utilizing the #XRPL and you spend your #BTC by utilizing a fraction of penny: .00005XRP.

The SEC concedes #BTC is not a security, but it claims the .00005XRP utilized to spend the #BTC is. 🤦
@Spend_The_Bits CEO @Jay_SpendDBits developed this app WITHOUT @Ripple. In fact, Ripple and @bgarlinghouse were unaware of this application. I highlighted this example along with others when I filed my motion to intervene. That’s the beauty of the technology.

AN OPEN LETTER TO @FinancialCmte @FSCDems @GaryGensler @HesterPeirce @SECHerrenLee FSC and SEC Members

I write ✍️ to you on this public platform hoping you will truly understand the damage being inflicted on innocent holders of #XRP. I represent 68,700 of those holders.
We are users, developers, small businesses, content providers and investors in the digital asset #XRP.

In 2015 #XRP became the first regulated cryptocurrency in the United States, when the @DOJCivil & #FinCEN settled w/ @Ripple declaring #XRP a

“convertible virtual currency.”
After #FinCEN declared #XRP a virtual currency, forcing sales to comply w/ U.S. Banking Laws (not securities laws), foreign governments, including the U.K. 🇬🇧, Japan 🇯🇵, Switzerland 🇨🇭, Singapore 🇸🇬, and the UAE 🇦🇪, followed suit - all declaring #XRP - a non-security.

The True Potential Of #XRP
Ripple was not just a currency; it was literally a global decentralized exchange. Already there were symbols to represent the US dollar, the Euro, gold, even other cryptocurrencies like Bitcoin, and just like the base currency XRP, these could all be
traded or sent within seconds. The most immediate and obvious benefit of this technology is the near instantaneous transaction time.
But Ripple can do so much more than just send money quickly. These symbols that you create so effortlessly can represent anything, not just money. It is not just a payments protocol.

XRPL DEX now supports USDC, USDT via @GateHub, and the first euro-backed stablecoin is soon to come via @stasisnet. Let’s check out the benefits of support offered for stablecoins on the #XRPLedger: 1/6
Many of XRPL’s core features (such as the world's first DEX) have been available since 2012. These features are extremely mature and functional, making it an ideal platform for stablecoin issuers to issue/manage assets of all kinds. 2/6
All they need to do is create an issuing account and set configuration options for the account and the particular stablecoin. That’s it. The XRPL’s native token functionality makes this possible. 3/6
