1/ Ok after engaging in a conversation with @MarkWEichenlaub I think I figured something out. The likely trigger for #Phase2 is Mueller’s report. Barr gave the clue. Mueller will report his prosecutions and declinations. Meaning he will list those things he did not prosecute.
2/ On that list will likely be matters discovered by Mueller but outside his scope and then brought to Rosenstein. It was then Rosenstein who would decide whether to expand Mueller’s scope or decide that there was no conflict in DOJ to prosecute.
3/ It is likely that Barr’s report which is based on Mueller’s report will explain these cases. It is Barr’s report that will be delivered to Congress and made public. That may be the mechanism that reveals what Huber has been working on.
4/ It’ll likely be heavily redacted but it will make plain that just because Mueller didn’t prosecute something doesn’t mean it was ignored.
