International Court of Justice rules that it has jurisdiction to adjudicate on alleged violations of Genocide convention by Myanmar.
The Court said that Gambia has power to invoke the powers under the Genocide Convention to bring to its notice the alleged violations by Myanmar.
The ICJ held that any State party to the Convention can invoke the jurisdiction of the Court even if it is not specially affected by the alleged violations.
This is in the case brought by Gambia against Myanmar on allegations of genocide of #Rohingyas
ICJ observes that #Rohingyas of Myanmar forms a "protected group" under the Genocide convention.

#Myanmar has tried to muddy the waters on jurisdiction and admissibility, but it is hard to imagine the Court not finding that it has prima facie jurisdiction here. Myanmar will have a second chance to make jurisdiction and admissibility arguments at the case's next phase. 3/12

Regarding installation of barbed wire fencing to prevent #Rohingya #refugees from leaving their camps, I found the comment by @KellyTClements Deputy High Commissioner of UN Refugee Agency, particularly disturbing. medium.com/@shafiur/caged…
"We’ll try to see how it can be implemented in a way that doesn’t adversely affect the refugee community nor the host". Sounds like there was no objection, yet this is such a backwards and damaging move for the well being and rights of #Rohingya #refugees.
It was exactly this type of pandering to Myanmar authorities by UN agencies that allowed the unfolding of the Rohingya genocide to take place, and now it sounds like they are taking the same approach in Bangladesh.

Day 2 #Gambia v #Myanmar #ICJ begins, w/#ASSK up first. She declares #genocide is a crime, applied by #ICTR to #Rwanda but not to #Kosovo or #Croatia by #ICTY or #ICJ, because of a lack of dolus specialis.
Gambia has put fwd 'Incomplete & misleading factual picture'. Situation in #Rahkine is 'complex & not easy to fathom'. (same rhetoric as we have heard for years)
Complexities go back for yrs. Claims conflict btwn Arakan Army w/5000 fighters & the #Myanmar Army, w/Arakan Army seeking independence. The conflict has led to displacement & security measures such as curfew & checkpoints, applied to all regardless of background.

Here we go. Commencement of provisional measures hearings at the #ICJ: first up, the appointment of the two #judges #adhoc - biographies of Navanethem Pillay & Claus Kress - chosen by #TheGambia & #Myanmar respectively. Art. 31, ICJ #Statute.
Priority of request of indication of provisional measures prioritized over all other cases, balanced with opportunity for parties to be represented. 3 hours per party Tuesday & Wednesday, after which reply on Thursday for each. ICJ Procedure.
No entering into merits of case, stick to requirements for provisional measures.

Migrants develop complex and creative strategies to navigate life in the Gulf — defying transience and establishing roots, homes or even claims of citizenship.
With a focus on #SaudiArabia Arabia, I looked at how generational migrants (or long-termers as @anaffissahely calls them) use religious imagery (seeking refuge near the Holy Mosque) or patriotic acts (donating blood to the armed services) as markers of belonging to the country.

1/4 The @UN Fact-Finding Mission on #Myanmar just published its latest report: not only does it make a finding of State responsibility for #Genocide, it also adresses the responsibility of other States in the prevention of such a crime. #Rohingya
2/4 "The Mission concludes on reasonable grounds that the evidence supports an inference of genocidal intent and, on that basis, that the State of Myanmar breached its obligation not to commit genocide under the Genocide Convention under the rules of State responsibility."
3/4 Moreover, the report confirms that "the Rohingya people remain at serious risk of genocide under the terms of the Genocide Convention." Such a "serious risk" triggers the obligation to prevent #Genocide that rests on ALL States parties to the Convention (ICJ, Bosnia-Serbia).

Tragically Omar was badly let down when clinics in the camp said they couldn't do anything to help him. This seems to be typical of treatment for the #Rohingya for anything out of the ordinary that would require specialist treatment. #HelpOmarFaisal

This is Omar Faisal with his dad who has never stopped fighting for him. For 6 years they tried to get him treatment for a condition that could have been easily treated as a baby. If left untreated he will go blind. #HelpOmarFaisal

We tried to fundraise privately and get Omar Faisal treated without any fuss, but when he caught pneumonia and the operation scheduled had to be cancelled we realised we would have to take his story public to raise more funds. But also his is a story that deserves to be told...

This is 6-year-old Omar Faisal. He has just recovered from a bout of pneumonia. And today, June 20, #WorldRefugeeDay he is returning to the plastic and bamboo home he shares with his #Rohingya parents & siblings in one of the world's largest refugee camps - in #Bangladesh
He is very happy as you can see from his pic.
Omar has a big challenge in front of him. Children with his condition, hydrocephaly, do not fare well if not treated early. Luckily, Omar can still talk ( he talks a lot!) and still has his sight. #WorldRefugeeDay
In #Myanmar, there was no opportunity for Omar to seek medical help. His parents even traveled to #Bangladesh when he was one but were thwarted by the large fee demanded by the hospital. Now Omar & his family are #refugees after the #Rohingya crisis of 2017. #WorldRefugeeDay

#BREAKING The Saudi government is deporting hundreds of #Rohingya refugees to Bangladesh.

Here's a video sent to me by an inmate in Shumaisi showing Rohingya being lined up, handcuffed, and prepared for deportation.
Voice notes from Rohingya inside Saudi Arabia tell me that Saudi prison guards rounded up loads of Rohingya in the middle of the night, and told them to get ready for Bangladesh.
Some of these Rohingya men, women, and children, have been inside Shumaisi, a Saudi detention centre, for the last five to six years.

This is rarely, if ever, done. Policymakers typically just impose sanctions in the vague hope that "pressuring the regime" will magically translate into the outcomes they seek. Usually they don't: sanctions fail 2/3 of the time. Myanmar was no different.
