EU toolbox update: New regulation "designed to protect EU funds from being misused by EU governments who bend the #ruleoflaw" approved by EP after being approved by Council on 14 Dec

To get my head around on how new mechanism will work I have put together yet another slide 😎⬇️
Step-by-step overview of new general (#ruleoflaw) conditionality mechanism for protection of #EUbudget

(any mistake PLMK)

(warning: rudimentary design of slide not pre-approved by @JoelleGrogan aka @stickytrickylaw but hope to convince her/"them" to help out with version 2.0) Image
@JoelleGrogan @stickytrickylaw Thanks to feedback received from @rdanielkelemen, I have corrected previous step 3

Exactly how long of a reprieve does this "explanatory declaration" grant Hungary & Poland from being subject to #RuleOfLaw mechanism?

Nobody knows. Some lawyers saying 2 years. EU Justice Commissioner saying only a few months.
The (rather predictable) response to #EUBudget compromise from 🇭🇺: "Hungary and Poland claimed a historic victory in the #RuleOfLaw negotiations".

In reality, the mechanism has remained intact. Application may or may not be delayed up to 2 years, depending on legal developments. Image
Belgian PM @alexanderdecroo says an urgent procedure could be used to avoid delays in the ECJ ruling.

The courts are "impartial" he says. “I do not think that it is a victory of one over the other, this is just a good way going forward.”

#EUCO leaders have talked through the night on two contentious issues: sanctions against Turkey and raising the EU’s 2030 emissions reduction target.

On thé latter, we’re close to a deal but not quite there yet. Eastern countries want more money for the energy transition.
But they are still stuck on the 2030 climate target as Poland wields its veto, just as it did for the 2050 target.

Last time Poland was bypassed and the target was signed by all except Warsaw. Will they have to do that again now?
PM #Morawiecki says he’ll only drop his climate veto if #Poland can keep more profits from #EUETS emission trading, reportedly telling the other leaders he’ll lose his job if he returns to Warsaw without this concession (having caved on his #EUBudget veto threat last night).

Polish PM #Morawiecki is one of the 1st to arrive

Uncharacteristically, he gives doorstep remarks in English about #RuleOfLaw. "Dear citizens of Europe" he says. The #COVID19 fund and MFF need to be agreed. But "we need to avoid any arbitrary and politically motivated decisions" Image
Polish PM says mixing #EUbudget and #RuleOfLaw "creates a very dangerous situation where politically motivated premises may stand behind the mechanism of attacking any country"

"Today we fear we may be attacked in an unjustified way. But in future it could be any country"
Sweden's PM Löfven, one of the hawks on #RuleOfLaw, enters #EUCO saying he thinks German compromise does a good job "making sure the agreement made between Council & Parliament stays as it is."

"There's no compromise on the content" Image

EU prime ministers and presidents are about to start arriving here for the #EUCO summit.

Key thing to watch as they make their doorstep remarks: any sign of wavering on #Brexit? Any openness to changing the negotiating mandate red lines?

So far there has been absolutely no sign Image
On #Brexit, @SwedishPM Löfven is "more gloomy today", he says entering #EUCO. "From what I hear there's no progress made in recent days."

"We've always said we're preparing for the worst and hoping for the best. But it's a difficult situation"

No indication of surrender. Image
The Polish & Hungarian prime ministers both chose to speak in English upon entering the #EUCO summit - a rarity. But neither mentioned #Brexit. They spoke about the imminent compromise on #EUbudget #RuleOfLaw dispute.

Brexiteers once thought Poland would be an insider ally in EU ImageImage

Hungary/Poland lift their veto on EU budget, after being reassured that new #RuleOfLaw mechanism won't be applied to them until a judgment of ECJ will define 'methodology' to be applied.

This is not only unprecedented, but also LEGALLY questionable THREAD #EUCO 1/ Image
The draft #EUCO Conclusions, a non-legally binding political declaration, de facto suspend application of #RuleOfLaw mechanism.

As such, notably point 2 c), could be challenged by an EU institution, such as the European Parliament, before @EUCourtPress as ULTRA VIRES 2/ Image
Regardless of whether #EUCO conclusions will be challenged, the inaction of the Commission while omitting to apply #RuleOfLaw mechanism pending the Court's judgement might also be challenged before the ECJ.

Art. 5 of the rule of law mechanism says that the Commission "shall" 3/ Image

Here are a few thoughts 👇
2/ While digital has changed political communication, it is important to remember the communication objectives remain the same:

📰 Media attention

🤝 Mobilisation
🙋 reaching people
🌐 Building networks and communities
3/ Digital has changed is the communications environment.

This morning @EUCouncil agree on historic 3y spending to kickstart the economy (750Bn€, w/ 390Bn grants & 360Bn loans) + 7y #EUbudget to invest in the long term (1.074Bn€). Before @Europarl_EN decides on this deal, let's see what’s in it: the good, the bad and the ugly. #Thread
Good n°1: Good news: there is a deal, and we are in July. I personally did not expect them to find an agreement before the fall, so having a deal in mid-July is already a positive piece of news in itself.
Good n°2: The overall architecture has not changed. Yes, less money will be invested than what was originally proposed (more👇), but we still get a reasonably sized budget (1.074bn€ over next 7y) + significant input of fresh money (390Bn€ in grants) that is good for #recovery

What is @eucopresident 'negobox' presented today?

Here's what today's 'negobox' proposes to use it for 👇

Big test now for the EU: preserving market confidence that it's got this and something will get through. The balance of grants vs loans matters less than showing that there's money available that can get where it needs to go.

#EUbudget #recoveryfund #covid19 #EURecoveryPlan
My colleague @gregclaeys makes a great point that these are workable numbers, not magic leverage best-case scenarios. The EU has too often fallen back on spreadsheet magic while limiting the actual money.
#EUbudget #recoveryfund #covid19 #EURecoveryPlan
National politicians could do a lot for constituents by emphasizing the benefits of moving quickly vs waiting for disaster to entrench itself. If, on the other hand, EU debate devolves into debt point scoring, things may get ugly. #EUbudget #recoveryfund #covid19 #EURecoveryPlan

Current discussions on the #EUbudget exemplify the EU's core problem. Instead of thinking about goals and what #EU citizens need from the Union, each Member State's executive looks at its own balance sheet, its net contribution, and what it pays in and receives. #IamEuropean
#EUbudget discussions should go the other way around. First, identify what the #EU should do for citizens, where it is needed, what it can bring. And only then work out how much this costs us all together. A discussion centred on 1% and 1.14% serves State budgets, not #citizens.
Timely follow-up on this thread, thanks to @clotilde_armand and @POLITICOEurope.…
