This is TOO EXCITING not to tweet.

#Germany started proceedings against #Italy at the #ICJ for alleged violations of its sovereign immunity.

It’s been a long time in the making. Many of us are probably not surprised. 🫢

It’s time for Germany v. Italy—Reloaded.

A thread 🪡
After the ICJ’s 2012 judgment in Germany v. Italy (link below), the Italian Parliament passed Law 5/2013. That law required Italian courts to decline jurisdiction in claims against Germany of the kind which had given rise to the ICJ litigation. 👩🏻‍💼…
Little did they know that the #ConstitutionalCourt would declare that law unconstitutional a year later, in the now-famous Sentenza 238/2014. 🙅🏻‍♂️

The Constitutional Court declared that the law was incompatible with the fundamental right…

As a result of the efforts of Raphael Lemkin, the term #genocide was included in the Indictment for the #Nuremberg Trials of 1945-46 under the category of War Crimes.
British deputy chief prosecutor Sir David Maxwell Fyfe used the term in June 1946 #Nuremberg during his cross-examination of Konstantin von Neurath, former Reich Protector of Bohemia and Moravia.
Maxwell Fyfe reminded Neurath that the prosecution was charging him and many of his fellow defendants with genocide, “which we say is the extermination of racial or national groups.”

In his closing speech at the #Nuremberg Trials in 1946, British chief prosecutor Sir Hartley Shawcross used the term #genocide to describe the Nazis’ “deliberate and systematic plan” to wipe out peoples and cultures.
Shawcross revisited the evidence about the Einsatzgruppen and Auschwitz.

But he also reminded the Tribunal that #genocide had not been limited to the murder of Jews and Gypsies.
Shawcross emphasized that the Nazis had pursued genocide “in different forms” in Poland, the Soviet Union, Yugoslavia, Czechoslovakia, and Alsace-Lorraine.

International law has been brought sharply into the spotlight today.

1. The ICJ found strongly in favour of Ukraine’s arguments vs Russia in stark & direct language.

1. shall immediately suspend the military operation in the territory of Ukraine

2. Shall ensure any military/irregular armed units directed or supported by it..take no steps to further such operation. 👇🏼 Image

1/ The far-reaching invasion of #Ukraine by the Russian Federation on 24 February 2022 poses the greatest threat to international peace and security in Europe since the end of World War II. The unjustified attack also impacts the relations between #Russia and

1. While most analysts see primarily a crime, I see primarily an error in Putin’s recognition of the two Russia-created East Ukrainian pseudo-states. This and the entry of regular Russian troops into the occupied territory are doubtlessly criminal & worrisome.
2. Yet, the East Ukrainian reality on the ground has so far not changed much with this "illegal legal" act and additional military presence. Instead, the larger political constellation of the conflict is arguably shifting to #Russia's disadvantage.
3. First, the always dubious and #Kremlin-imposed #MinskAgreements will not any longer be available as instruments of #Russian political pressure on #Ukraine. Second, the #West will now close ranks with Ukraine in view of #Russia's new blatant violation of #InternationalLaw.

I attended as an individual. I am not affiliated with any PAC or organization. I obviously do not speak for or represent the #Palestinian people. There’s like 7 million of us at least, and like 2 million of #Palestinians stuffed in #Gaza alone.
To the #Palestinian Americans who boycotted this meeting after the #Biden Administration handed Israel $735 million dollars in weaponry following the merciless attacks on Palestinians locked in Gaza.

Thread: The statements and evidences on the horrendous atrocities taking place in the war on #Tigray #Ethiopia are mounting, despite the fed gov imposed information blockage. | Terrified' survivors recount attacks on civilians in Tigray | AFP via @YouTube
It seems clear that widespread and systematic #humanrights violations mounting to #CrimesAgainstHumanity and #WarCrimes are taking place in #Tigray #Ethiopia.
Whether we are also observing a #Genocide in the making in #Tigray #Ethiopia, is leagally speaking too early to confirm due to lack of access. #GenocideWatch and #UN special advisor on the prevention of genocide have expressed concerns in this regard however.

#Uyghurs The implications of this new evidence, impacting 20% of the world’s cotton: Companies must consider all cotton produced in Xinjiang *may* be tainted with forced labor.

This has immediate implications for supply chains across the fashion industry.

The this new evidence on forced labour in #Xinjiang to produce cotton should impact govts considering implemention of new human rights due diligence laws, to ensure companies can no longer turn a blind eye to abuses in their supply chains. #modernslavery…
Today I am giving evidence to @CommonsForeign on accountability in international law for atrocities in Xinjiang against Uyghurs and other Turkic Muslims.

This new evidence on #forcedlabour shows again why govts must take concrete steps to ensure corporate accountability too.

1) Let's game out what a realistic independence movement in #space might look like. AS ALWAYS these views are my own. We're going to need to draw from #spacelaw, #internationalrelations, #InternationalLaw, and #history here. A thread.
2) Let's posit that the goal is a sovereign, self-governing habitation on #Mars, free-floating, or on the #Moon, not subject to control by a terrestrial country. How do we get from where we are now to there? Yes we've all read Moon is a Harsh Mistress and the Red Mars trilogy.
3) The first thing to realize is that you can't do this in one step. Ops in space are entwined with terrestrial activities and governments so separation is hard. As for law, the #OuterSpaceTreaty requires countries to exercise jurisdiction & control over activities, even private.

UK membership of EU facilitated the delivery of the agreement in a manner which respected both communities. It was the Johnson Govt’s CHOICE of a hard Brexit which has brought about the need for a BORDER IN THE IRISH SEA, to avoid a hard border on the island of Ireland.
The land border is:
310 miles long
>200 crossing points
110 million people crossing annually
up to 30,000 crossing daily for work

NI Statistics & Research Agency estimates two-thirds of Northern Ireland-Republic of Ireland trade is linked to cross-border supply chains. 2/
In view of potential consequences for increasing the TENSIONS within NI/Irish border communities, it's CHILLING to note Clause 47 explicitly disapplies Section 6(1) of the Human Rights Act, which requires public authorities to act in a way that is compatible with the ECHR!😱😢3/

OMG! @HLConstitution seems unanimous condemnation of UK govt!! Sir Frank has puts his finger on PRACTICAL Q:Why has govt NOT managed to contain within disputes procedures? As:
"Effect is dramatic; it's EXPLOSIVE!" WOW!! So many high profile QCs outraged😱
@ProfMarkElliott -brilliant in countering Sir Stephen Laws' case precedents (Laws seems sheepish & embarrassed!) as irrelevant! Huge difference re incompatibility as here Govt DELIBERATELY setting out to breach International obligations= a different order of magnitude!
Ministerial Code not legally binding but encouraging ministers to treat International obligations in
"cavalier fashion" is concerning! About standards & requirement to act in accordance with the law -so needs reframing appropriately!?

I have just emerged from a long desk day advising on the law of the land to discover it has been a shameful day for law, and the rule of law, in the UK.

Something is rotten in any state that promotes this.

And one doesn’t get credit for breaking just a little bit of the law.
And you can take that also from a former Lord Chancellor.

Struggling to close my jaw as I catch up on today’s developments faultlining where law meets politics.
And we can tune in now to hear it from the UK’s former Ambassador to the US @KimDarroch, as well.

I’m still dumbfounded by @BrandonLewis comments on international law. Break the law a tiny bit.

Just as we have been arguing all along, the #Jewish communities in Judea and Samaria, what some call the #WestBank, are not illegal nor do they violate #InternationalLaw. For a territory to be deemed ‘occupied’, it needs to be seized from a rightful owner.
Neither #Jordan nor the #PalestinianAuthority had any lawful title to the land when they launched the June ‘67 war against us. It was, in fact, Jordan that illegally annexed the territory in 1948, occupied it for 19 years and no one besides Jordan recognized this seizure.
Accordingly, when #IDF soldiers retook the territories in ‘67, they entered the land which no other entity had any lawful title to.
